GENERAL TERMS FOR PRODUCT RENTAL

1. Scope

These general rental terms apply to all rental agreements made by the customer with OTTO Design Oy (2036885–7). The customer is hereinafter referred to as the “Lessee” and OTTO Design Oy as the “Lessor”. The Lessee accepts these rental terms as binding upon concluding the rental agreement.

2. Processing of Personal Data

Renting products requires the processing of personal data. OTTO Design Oy acts as the data controller and processes your personal data to allow you, as the Lessee, to rent products. Further information on the processing of your personal data is available in the privacy policy.

3. Rental

OTTO Design Oy owns the web service ottovuokraus.com, through which OTTO Design Oy rents products in Finland to Finnish companies and adults.

Products are rented by selecting the desired rental period from the calendar on the website and adding the rental to the shopping cart.

The rental price of a product depends on the length of the rental period. Possible rental periods and pricing principles of the product are indicated on the product page. When the Lessee selects the desired rental period, the service shows the rental price for the selected period. Rental prices include value-added tax (24%).

The rental period starts on the delivery day at 7:30 a.m. and the product must be returned to the Lessor by 5:00 p.m. on the return day unless otherwise stipulated in these rental terms. The rental period includes the delivery and return days.

Extending the rental period during the rental is possible if the booking situation allows it. An additional fee will be charged for the extended rental period according to the price list, as a new rental.

The Lessor has the right to charge a deposit for rented products if necessary.

Once you have rented and paid for the product on the website, i.e., the order is completed, we will send you a booking confirmation to the email address you provided.

4. Payment Terms

The rental is paid for in the web service. The payment intermediary for the online store is Visma Pay (Visma Payments Oy, 2486559–4), which is registered in the Financial Supervisory Authority’s payment institution register. Payment is made through the Visma Pay web service, and the account statement and invoice will show Visma Pay or Visma Payments Oy as the recipient of the payment. Payments are safe as all payment transaction details are transmitted using an encrypted connection, ensuring that no external parties can see the payment transaction details.

Payment through the Visma Pay service can be made with online banking credentials, a wallet, payment cards (credit/debit), invoice, or installment payments. The following payment methods are available: Osuuspankki, Nordea, Danske Bank, Oma Säästöpankki, Säästöpankki, Aktia, Local Cooperative Banks, S-Pankki, Handelsbanken, Ålandsbanken, MobilePay, Masterpass, Pivo, Siirto, Visa, Visa Debit, Visa Electron, MasterCard and MasterCard Debit cards, and Jousto, Fellow Invoice and Fellow Company Invoice.

MobilePay: You can pay with your MobilePay wallet if you have allowed payments in online stores in the app settings. Payments made with the MobilePay wallet are debited from the payment card linked to the wallet. If debiting from the payment card fails, payment with the MobilePay wallet is not possible in the online store.

Pivo: Terms of use are available on Pivo’s website: https://pivo.fi/kayttoehdot/pivon-kayttoehdot/

Jousto invoice and installment payment is a domestic service that allows you to make purchases quickly and safely. Jousto is intended for private individuals who have managed their financial affairs flawlessly. With Jousto, you get 30 days of interest-free and cost-free payment time. Once you receive the invoice, you can decide whether to pay it in full or in parts. Installment payments can be spread over up to 36 installments, starting from 9.90 euros/month. Jousto installment costs are 3.90 euros/month and a 19.90% credit interest rate. You can pay for purchases between 30–3000 euros with Jousto. Aurajoki Nordic Oy is the credit provider. Learn more about Jousto at www.jousto.com.

In addition to the above, Finnish companies have the option to pay for their rental by invoice. The payment term is 14 days from the invoice date. To arrange rental payments by invoice, we request you to contact the Lessor directly.

5. Delivery Methods and Costs

The Lessee can choose pickup from OTTO Design Oy’s location in Vantaa, OTTO Design Oy’s home delivery, or delivery as a Posti home package.

Pickup occurs at OTTO Design Oy’s location in Vantaa (Viisaritie 29, 01640 Vantaa) at a separately agreed time. The Lessor will contact the Lessee upon receiving the order to agree on a more precise pickup time.

OTTO Design Oy’s delivery areas for home delivery are the capital region (Helsinki, Vantaa, Espoo, Kauniainen, Kirkkonummi, Nurmijärvi, and Kerava) as well as other Uusimaa. Home delivery elsewhere in Finland is possible by agreement, and we ask you to contact the Lessor directly for this. A specific delivery time must be agreed separately with the Lessor. The Lessor will contact the Lessee upon receiving the order to agree on a more precise delivery time.

Delivery as a Posti home package takes place to the Lessee’s doorstep by Posti.

You will see the delivery cost in the order summary after selecting the delivery method and location.

The delivery time is not included in the rental period.

6. Cancellation

According to the Consumer Protection Act, a private individual has the right to cancel a contract no later than 14 days after the contract is made on the website, in this case from the order date. The cancellation period ends 14 days after the contract is made. If the consumer wishes to exercise their right of cancellation, they must notify the Lessor in writing by email before the cancellation period expires. If the consumer uses their right of cancellation after the contract has been fulfilled by the Lessor, the consumer must promptly return the product following the given return instructions. The consumer may then be required to pay reasonable compensation for the performance provided to fulfill the contract. However, the consumer does not have the right to cancel if the rental has been fully performed.

Companies have the option to cancel a contract no later than one day (24 hours) before the rental starts. Notify of the cancellation in writing by email. For cancellations made later, we will charge the full rental price and delivery fee according to the chosen delivery method.

7. Product Return

The return method is the same as the chosen delivery method. The delivery fee also includes the return fee.

If the Lessee returns the product ahead of schedule, the Lessor is not obliged to compensate for the shortened rental period.

For pickup deliveries, returns are made to OTTO Design Oy’s location in Vantaa (Viisaritie 29, 01640 Vantaa) at a separately agreed time. The Lessor will contact the Lessee upon receiving the order to agree on a more precise return time. Products must nevertheless be returned to the location by the last rental day at 5:00 p.m. at the latest.

For home deliveries by OTTO Design Oy, the products are picked up from the same address they were delivered to. A specific return time must be agreed separately with the Lessor. The Lessor will contact the Lessee upon receiving the order to agree on a more precise return time. Products are picked up in any case by the last rental day at the latest.

For deliveries as a Posti home package, products must be returned to a Posti service point chosen by the Lessee by the last rental day at 5:00 p.m. Before returning to Posti, the Lessee must ensure the product is properly packed in the box in which it was delivered to the Lessee. If the product is not packed in the above-mentioned manner and the product is damaged upon return, the Lessee is responsible for the repair costs or the replacement cost, whichever is lower.

The replacement cost is always the manufacturer’s recommended retail price for the product. The replacement cost for a Kärcher Puzzi textile cleaner 8/1c is 611.94 euros.

If the product return is delayed and the product is not returned immediately after the rental period ends, additional rental will be charged to the Lessee for each delayed day. Additional rental is calculated based on the product’s shortest rental period’s daily rental rate. If the return is delayed by more than ten (10) days, it is considered that the Lessee has purchased the rental product at the replacement cost. The replacement cost for the rental product will be billed to the Lessee separately in addition to the additional rental.

The Lessee is responsible for cleaning the product according to the instructions provided before its return. The product must be returned carefully cleaned and in good condition, taking normal wear into account. If the product is not cleaned or not returned in good condition, the Lessor may charge either the necessary cleaning and repair costs or the replacement cost of the rental product, if it is less than the cleaning and repair costs.

The product must be returned complete. Missing parts will be charged to the Lessee at the replacement cost of the new part. If the part cannot be obtained separately and a completely new product must be acquired, the Lessee is responsible for the full replacement cost of the product.

8. Use and Responsibility

The Lessor owns the rented products. The Lessee may not mark or otherwise alter the product or its parts. The Lessee may not re-rent the products or lend, pawn, or otherwise transfer them to others or make them available to others. Products may not be taken abroad.

The product may only be used for purposes for which it is intended (see manufacturer’s product description and usage instructions, as well as the usage and cleaning instructions provided with the product). The usage instructions and product information are also available on our website.

The Lessee must familiarize themselves with the usage and cleaning instructions provided with the product before using the product. The Lessee must also familiarize themselves with the product thoroughly and ensure its correct operation and cleanliness before use. If the correct operation and cleanliness of the product are not assured by the Lessee before use in conditions where it would not cause damage to the Lessee’s property, the Lessor is not obliged to compensate for any damages.

If the product breaks during normal use according to the instructions, the Lessor is responsible for the product breaking. The Lessor is also responsible for the product’s normal wear.

If the Lessee uses the product contrary to the instructions or for a purpose other than its general intended use and the product breaks, the Lessee is responsible for the breakage. In this case, the Lessee is obliged to pay the Lessor a compensation equivalent to the product’s replacement cost.

The Lessor cannot oversee how and under what conditions the Lessee uses the product. Therefore, the Lessor is not responsible for any damage that may be caused to the Lessee, external individuals, or objects when the Lessee uses the product. The Lessor is, however, liable for personal or property damage directly resulting from a defect in the product and where the Lessee’s handling of the product has not been a factor. Despite this, the Lessor is never liable for damages caused to external individuals.

The Lessee is obliged to safeguard the product so that it is not lost or stolen. If the product is lost or stolen, however, the Lessee is obliged to pay the Lessor a compensation equivalent to the product’s replacement cost.

If the Lessee notices a defect in the product, the product breaks or is damaged, is lost or stolen, the Lessee must complain to the Lessor on the same day that they notice the defect, breakage, damage, disappearance, or theft. In case of theft, the Lessee must also report it to the police on the day the theft is noticed.

If the Lessor notices that the Lessee has provided false information, neglected to pay the rent, used the product contrary to the rental terms, or otherwise violated the agreement, the Lessor has the right to terminate the contract immediately and take back the product.

9. Dispute Resolution

The consumer has the right to bring a dispute to the Consumer Disputes Board or court proceedings. If the consumer chooses court proceedings, the matter will be resolved in the lower court of the consumer’s place of residence or the Lessor’s place of residence.

Disputes between companies will be resolved in the lower court of the Lessor’s place of residence.
